This bill requires Kentucky law enforcement agencies to take specific actions when they seize, recover, or encounter firearms potentially connected to criminal activities. When a law enforcement agency obtains a firearm that was unlawfully possessed, used for an illegal purpose, found at a crime scene, or believed to be associated with criminal conduct, they must: (1) transmit and receive information about the firearm through the National Crime Information Center system and the U.S. Alcohol, Tobacco, Firearms and Explosives (ATF) eTrace system, (2) arrange for the firearm to be test-fired and submit the test-firing results to the National Integrated Ballistic Identification Network (NIBIN) to determine potential criminal connections, and (3) similarly submit ballistics information from recovered spent shell casings to NIBIN when they are found at crime scenes or believed to be related to criminal activities. Additionally, local law enforcement agencies must develop and obtain Justice and Public Safety Cabinet approval for policies and procedures governing the recovery and forensic processing of firearms and firearm-related evidence in criminal investigations, with the goal of creating a more comprehensive and interconnected approach to tracking and investigating potential criminal firearm use.
