This bill creates a new section in Kentucky law aimed at restricting certain types of food purchases through the Supplemental Nutrition Assistance Program (SNAP, commonly known as food stamps). The bill defines "accessory foods" as items with low nutritional value, including energy drinks (beverages with at least 65 milligrams of caffeine per 8 fluid ounces, excluding coffee), prepared desserts like cookies, candy, ice cream, cakes, and pies, potato or corn chips, and soft drinks. The bill requires the secretary of the Cabinet for Health and Family Services to request a waiver from the U.S. Department of Agriculture to prevent SNAP recipients from using their benefits to purchase these types of foods. If the waiver is granted, the secretary must prohibit the purchase of these accessory foods with SNAP benefits. If the initial waiver is not approved, the secretary is instructed to resubmit the waiver with modifications as directed by the General Assembly. The goal of this legislation appears to be promoting healthier food choices among SNAP participants by limiting the use of benefits for items considered to have minimal nutritional value.
