This bill requires all local law enforcement agencies in Kansas, including city police departments, county sheriff's departments, and other local law enforcement entities, to actively seek and enter into agreements with U.S. Immigration and Customs Enforcement (ICE) under Section 1357(g) of the federal Immigration and Nationality Act. These agreements would authorize certain local law enforcement officers to assist in enforcing federal immigration laws. If an ICE agreement is offered, the law enforcement agency must accept it and submit a copy to the state attorney general. If an agency fails to enter an agreement or does not receive an offer from ICE, it must submit written documentation to the attorney general explaining the situation. The bill establishes a compliance mechanism where agencies receive written notices to become compliant within 30 days, and the attorney general can bring legal action against non-compliant agencies in Shawnee County district court. Agencies found to be in violation can lose eligibility for state grant money in the following fiscal year. The bill defines "law enforcement agency" broadly to include various local law enforcement departments and "state grant moneys" as financial aid from state agencies. The act will take effect upon publication in the Kansas register.
