This bill creates the School Board Member Recall Act, which establishes a process for recalling school board members elected during a consolidated election. Under this law, a recall petition organizer who resides in the school board member's jurisdiction can initiate a recall election by filing an intent to recall with the local election authority after the board member has served more than one year. The petition must gather signatures from either 25% of the votes cast in the last gubernatorial election or 10,000 jurisdiction residents, whichever is less. Petitions can only be circulated and filed 120 to 180 days before a consolidated election, and must clearly state "RECALL PETITION" and the reason for the recall. If a recall election is successful, the ballot will ask voters whether the school board member should be removed and who should replace them. Replacement candidates must be certified through the same procedures as a standard consolidated election, following standard candidate filing requirements. The bill aims to provide a structured mechanism for constituents to remove school board members they believe are not serving their community effectively.
