AI Summary
This bill amends the Student Online Personal Protection Act (SOPPA) to strengthen protections for student data privacy. Specifically, the bill adds a new provision that allows any individual who has been harmed by an operator's violation of SOPPA to pursue legal action either in a state circuit court or as a supplemental claim in a federal district court against the operator. The bill also reinforces existing enforcement mechanisms by maintaining that violations of the Act can be addressed by the Attorney General under the Consumer Fraud and Deceptive Business Practices Act. Additionally, the bill includes a requirement for vendors of state-administered assessments used for higher education admissions to refrain from selling or commercially exploiting "covered information" (which typically includes personally identifiable student data) that they have accessed through their vendor relationship. This amendment aims to provide additional legal recourse for individuals and prevent potential misuse of sensitive student information by educational technology providers and assessment vendors.
