The bill defines "creative or artistic expression" broadly to include music, dance, performance art, visual art, poetry, literature, film, and similar media, while explicitly excluding hand signs indicating gang membership and tattoos. Under the proposed law, evidence of a defendant's creative or artistic expression is presumed inadmissible in criminal proceedings. To introduce such evidence, the prosecution must prove three key elements by a preponderance of evidence: (1) the defendant adopted the literal meaning of the work as their own statement, (2) the expression specifically references facts of the alleged crime, and (3) the evidence is relevant to a disputed fact. If the court decides to admit such evidence, it must carefully redact potentially prejudicial content, provide appropriate jury instructions, and use the least prejudicial method of presentation. The bill maintains that admitted creative or artistic expression evidence remains subject to existing rules of evidence, ensuring that the new provisions do not override other established evidentiary standards.
