Bill Summary

AN ACT To amend Chapter 13 of Title 44 of the Official Code of Georgia Annotated, relating to exemptions from levy and sale of property, so as to provide for the exemption of the full value of a debtor's primary residence from levy and sale by virtue of any process whatever under the laws of this state; to provide for the exemption, for purposes of bankruptcy, of the full value of a debtor's aggregate interest in his or her primary residence; to provide for related matters; to provide an effective date; to repeal conflicting laws; and for other purposes.

AI Summary

This bill amends Georgia law to provide expanded protections for homeowners by allowing the full value of a debtor's primary residence to be exempt from levy and sale under state law and for bankruptcy purposes. Specifically, the bill modifies existing statutes to replace the previous limit of $21,500 with an exemption for the full value of a primary residence, meaning that creditors cannot seize or force the sale of a person's home to satisfy debts. For bankruptcy proceedings, the bill adds a new provision that allows debtors to exempt their entire interest in their primary residence, regardless of its value. This change provides significant additional protection for homeowners facing financial difficulties, ensuring they cannot be completely displaced from their primary residence due to outstanding debts. The bill will take effect on July 1, 2025, and repeals any conflicting laws, representing a substantial expansion of homestead exemption rights for Georgia residents.
