This bill amends the Retirement and Social Security Law to provide equal retirement benefits for individuals appointed to certain leadership positions within the New York State Department of Corrections and Community Supervision (DOCCS), specifically correction lieutenant, correction captain, deputy assistant superintendent, and superintendent. Previously, eligibility for certain retirement plans, particularly those allowing for a 25-year service retirement, was more restrictive, often requiring a minimum of seven years of service as a superintendent. This legislation allows individuals appointed to these higher ranks to elect to join a retirement plan that may offer a 25-year service retirement, or an age-based plan requiring them to be 55 years old, within ninety days of their appointment or within ninety days of the bill's effective date if they already hold one of these titles. This change is expected to result in a one-time past service cost of $40.4 million to the state, but will not increase annual contributions.
