This bill grants retroactive membership with Tier 1 status in the New York State Teachers' Retirement System to James J. DeMarco, allowing him to be treated as if he joined the system on July 17, 1969, the date he began employment with the New York Power Authority as a seasonal employee, even though he did not become a member of the New York State and Local Employees' Retirement System at that time due to circumstances beyond his control. This reclassification, which requires Mr. DeMarco to file an application within one year of the bill's enactment, will result in his pension being recalculated with a retroactive adjustment to payments made since his retirement on December 7, 2007, and the estimated cost of this benefit, approximately $98,200, will be borne by the employers of members of the New York State Teachers' Retirement System.
