Bill Summary

This bill relates to consumer fireworks. Under current law, Code section 727.2 provides that a person shall not use or explode consumer fireworks on days other than June 1 through July 8 and December 10 through January 3 between the hours of 9:00 a.m. and 10:00 p.m. with the following exceptions: on July 4 and the Saturdays and Sundays immediately preceding and following July 4, between the hours of 9:00 a.m. and 11:00 p.m.; on December 31 between the hours of 9:00 a.m. and 12:30 a.m. on January 1; and between the hours of 9:00 a.m. and 11:00 p.m. on the Saturdays and Sundays immediately preceding and following December 31. Under current law, a board of supervisors or city council may by ordinance or resolution prohibit or limit the use of consumer fireworks, display fireworks, or novelties, as S.F. _____ described in Code section 727.2. A board of supervisors must first determine that the use would constitute a threat to public safety or private property or a nuisance to neighboring landowners. No such determination is required by a city council. The bill prohibits a board of supervisors or city council from restricting or limiting the use of consumer fireworks, display fireworks, or novelties, as described in Code section 727.2, on July 3, July 4, or December 31 in accordance with Code section 727.2(4). A person who violates Code section 727.2 commits a simple misdemeanor.

AI Summary

This Study Bill, related to county and city regulation of consumer fireworks, amends existing law by preventing county boards of supervisors and city councils from restricting or limiting the use of consumer fireworks, display fireworks, or novelties on July 3, July 4, or December 31, provided their use adheres to the specific timeframes outlined in Code section 727.2, subsection 4. Previously, these local governing bodies had broader authority to prohibit or limit fireworks use, with county supervisors needing to demonstrate a threat to public safety or property or a nuisance, while city councils did not require such a determination. The bill clarifies that these specific holidays are now protected from local restrictions, though violations of the general fireworks use laws, which are classified as simple misdemeanors, remain punishable.
