This bill amends Tennessee law to establish stricter requirements for commercial driver's license (CDL) holders' English language proficiency, drawing from federal regulations (49 CFR 391.11(b)(2)). The legislation requires enforcement officers to issue an out-of-service order to commercial drivers who cannot read and speak English sufficiently to understand traffic signs, converse with the public, respond to official inquiries, and complete required reports. If such a driver is identified during a safety inspection, their vehicle cannot be operated until a qualified driver who meets the English language requirements is present. The driver's commercial license will be suspended until they pass a specific English language proficiency test developed by the Tennessee Department of Safety. Importantly, the employer bears financial responsibility for any fines or fees resulting from the license suspension, and can be issued a $500 citation for employing a driver who fails to meet these language requirements. The bill includes a narrow exception for drivers who have hearing-related exemptions and can read and write in English. The law will take effect partially upon becoming law (for rule-making purposes) and fully on January 1, 2026, with the goal of ensuring commercial drivers can effectively communicate and operate vehicles safely.
