This bill requires local education agencies (LEAs) to submit comprehensive lists of underutilized or vacant property to the department of human services and the comptroller of the treasury, with the goal of providing child care facilities more opportunities to access these properties. Specifically, the bill grants child care facility owners (excluding corporate-owned facilities) a right of first or second refusal to lease or purchase these properties at fair market value, depending on whether public charter schools are present in the LEA. The bill establishes a detailed process for property valuation, requiring two independent appraisals to determine fair market value. Child care facilities leasing such properties would be responsible for routine maintenance and utilities, while extensive capital repairs remain the LEA's responsibility. If a child care facility closes or stops using the leased property, it must be returned to the LEA's vacant property list, and the LEA gains the right of first refusal to repurchase the property. The legislation aims to create more flexible use of educational properties for child care services while preserving LEAs' ability to plan for their property use. The bill will take effect on July 1, 2025, and applies to LEAs across Tennessee.
