This bill includes three primary provisions aimed at improving services for people with disabilities and enhancing government oversight. First, the bill transfers the driver training program for persons with disabilities from the Department of Aging and Disability Services to the Department of Motor Vehicles, modifying procedures for evaluating and training disabled individuals who need special vehicle equipment to operate a motor vehicle. Second, the bill requires the Commissioner of Social Services to submit any Medicaid state plan amendments to the joint standing committees of the General Assembly and the Council on Medical Assistance Program Oversight at least 30 days before seeking federal approval, allowing legislative review and potential amendments. Third, the bill establishes penalties for wheelchair repair dealers who demonstrate "systemic noncompliance," defined as failing to meet timely repair requirements for more than 5% of repair requests in a 30-day period, by classifying such failures as an unfair or deceptive trade practice. These changes are set to take effect on July 1, 2025 (for the first two provisions) and November 1, 2025 (for the wheelchair repair dealer provision), with the goal of improving services, oversight, and accountability in state agencies and for individuals with disabilities.
