This bill establishes a new complaint process for individuals who believe their name or address was included in a document filed with the Tennessee Secretary of State without their consent. The bill allows a person to file a complaint with detailed information, including the document description, personal contact information, and business entity details. Upon receiving a complaint, the Secretary of State must send a notice to the business entity within ten business days, giving them twenty-one business days to respond. The Secretary of State will then review the complaint and response, and if clear and convincing evidence shows the name or address was included without consent, the Secretary of State can void the business record. If no response is received, the allegations are deemed admitted. The bill requires the Secretary of State to issue a decision within thirty business days and provide written notice to all parties. Importantly, if a filing is voided, the original filer will not receive a refund of filing fees. The complaint and response will be considered public records, and the bill provides for judicial review of the Secretary of State's decision. The law is set to take effect on July 1, 2025, and applies to documents filed under Tennessee Code Annotated, Title 48 and Title 61.
