This bill amends the Developmental Disability and Mental Disability Services Act to modify home-based services funding for adults with mental disabilities. Currently, there are strict limits on monthly service funding—300% of Supplemental Security Income (SSI) for individuals not in special education and 200% for those in special education programs. The bill introduces a new provision that allows the Department of Human Services to exceed these funding limits for individuals with higher service and support needs, but only subject to available appropriations. When approving additional funding, the Department must base its decision on a formal determination of need, administered either directly or through a service coordination agent. Any additional funding must be incorporated into the individual's service plan and must align with Department-established criteria. The Department is also given the discretion to restrict these additional funds specifically to services that enable the individual to continue living in the community. The bill permits the Department to adopt rules to implement this new funding mechanism and maintains existing provisions allowing approved funds to be used for tangible items directly related to meeting basic needs associated with mental disabilities.
