This bill allows counties in Tennessee to offer a property tax exemption for portions of real property that are covered by tree canopy, but only if the county's local governing body votes to adopt this exemption. The bill defines "tree canopy" in several ways, including as the branches, leaves, and stems of trees covering at least 5,000 square feet when viewed from above, or the area within a tree's "dripline" (the area where water drips from the tree's canopy). A designated "implementing agency" within the county, such as the planning commission or assessor's office, will be responsible for determining which parts of a property qualify for the exemption, using methods like tree canopy studies or aerial imagery. Property owners must apply for this exemption, and the state board of equalization, along with the county implementing agency, will review and approve applications. The exemption applies only to the value of the property covered by the tree canopy, and it can last for up to seven years, with the possibility of an additional seven-year extension if the tree canopy coverage is maintained. If the tree canopy is removed or reduced during the exemption period, the exemption becomes void, and the owner may owe back taxes. This exemption is optional for counties and requires a two-thirds vote of the county governing body to be implemented.
