Bill Summary

AN ACT To amend Chapter 1 of Title 10 of the Official Code of Georgia Annotated, relating to selling and other trade practices, so as to extend certain protections for consumers relative to warranties of HVAC systems and components of such systems; to allow for transfers of certain manufacturers' warranties of HVAC systems and components of such systems; to prohibit manufacturers', distributors', and retailers' warranties of HVAC systems and components of such systems from being conditioned upon product registration; to provide required information for warranty and product registration cards and forms; to provide an effective date for certain warranties of HVAC systems and components of such systems; to provide a definition; to provide for an effective date and applicability; to provide for related matters; to repeal conflicting laws; and for other purposes.

AI Summary

This bill modifies consumer protections for HVAC (heating, ventilation, and air-conditioning) system warranties in Georgia by establishing three primary provisions: First, when a residential property with an HVAC system is sold to a new owner, the existing manufacturer's warranty will automatically transfer to that new owner without additional fees, continuing in effect as if the new owner was the original purchaser, though the warranty's remaining term will not be extended. Second, manufacturers, distributors, and retailers are prohibited from conditioning warranties on product registration, and any warranty registration cards or forms must clearly state that failure to complete and return the registration will not diminish warranty rights or decrease the warranty term. Third, the full term of an HVAC system warranty will be effective from the date of installation, specifically when the installation is performed by a contractor licensed under Georgia's Chapter 14 of Title 43. The bill will become effective on January 1, 2026, and will apply to warranties manufactured, issued, sold, or offered for sale on or after that date, with the goal of providing clearer and more consumer-friendly warranty protections for HVAC systems.
