AI Summary
This bill amends Georgia law regarding property owners' associations by introducing several key provisions: First, associations must now provide lot owners with a free certificate of good standing within 45 days of each fiscal year's end if all assessments have been paid in full. The bill also establishes a comprehensive alternative dispute resolution (ADR) process that associations must implement, which includes adopting a written policy for resolving disputes about assessed sums, using local dispute resolution programs, and ensuring the process is fair and accessible. Notably, the ADR procedure must be free for lot owners, can be initiated by the owner in writing, and requires the association to participate if requested. The bill further stipulates that associations must act in good faith during dispute resolution, with potential attorney's fees awarded to an aggrieved party if the other side does not negotiate reasonably. Additionally, the bill modifies lien provisions, making association liens inferior to medical bill liens and requiring the association to offer ADR before creating a lien for unpaid assessments. The new regulations will not apply to contracts entered into before July 1, 2025, providing existing agreements a transition period. These changes aim to provide more protections and fair processes for property owners dealing with homeowners' associations.
