Bill Summary

AN ACT relating to disclosures required to record an instrument conveying real property.

AI Summary

This bill requires that when recording an instrument (such as a deed) conveying real property in Texas, the document must now be accompanied by a detailed notice of real property title transfer. The notice must include specific information about both the grantor and grantee, such as full names, addresses, social security or taxpayer identification numbers, citizenship status, and details about the property and transaction. The form, to be prescribed by the commissioner of the General Land Office, must be signed under oath or as an unsworn declaration by both parties. The notice will be retained confidentially by the county clerk and can only be disclosed to state agencies for governmental purposes. The bill specifies that these new requirements will apply only to instruments filed for recording on or after January 1, 2026, giving time for the necessary rules and forms to be developed. The commissioner of the General Land Office is required to adopt implementation rules by December 31, 2025, and the act will take effect on September 1, 2025.
