Bill Summary

As enacted, makes various changes relative to the authority of a physician or podiatrist to prescribe, dispense, or administer medication to the provider's own self or immediate family; makes related changes. - Amends TCA Title 33; Title 39; Title 53; Title 63 and Title 68.

AI Summary

This bill generally prohibits physicians and podiatrists from prescribing, administering, or dispensing medication for, or otherwise treating, themselves or their immediate family, which includes their spouse, parents, children, siblings, or anyone with whom they have a personal or emotional involvement that could impair their professional judgment. However, exceptions are made for short-term, minor, or acute emergency situations. Specifically, physicians and podiatrists can only prescribe scheduled drugs, which are medications listed in federal Controlled Substances Act schedules, to themselves or their immediate family in acute emergency situations. There are also provisions allowing treatment of immediate family if no other healthcare provider is available within a 30-mile radius of the physician's or podiatrist's practice. Furthermore, if a physician or podiatrist has an established patient-provider relationship with an individual they supervise or collaborate with, that supervisee can treat the physician or podiatrist or their immediate family, but only in acute or emergency situations, and this restriction also applies to the prescription of scheduled drugs. All such treatments must be documented.
