Bill Summary

Amends the Recyclable Metal Purchase Registration Law. Provides that provisions prohibiting the sale of certain recyclable metal materials shall not apply if the seller produces written documentation reasonably demonstrating that the seller is the owner of the recyclable metal material or is authorized to sell the recyclable metal material on behalf of the owner. Provides that the recyclable metal dealer shall copy the documentation provided by the seller and maintain the copy of the documentation along with the purchase records. Provides that the sale of a detached catalytic converter may occur at the fixed business address of the seller or of the recyclable metal dealer (rather than at the fixed business address of the licensed recyclable metal dealer). Changes references from "licensed recyclable metal dealer" to "recyclable metal dealer".

AI Summary

This bill amends the Recyclable Metal Purchase Registration Law to modify regulations around the sale of certain recyclable metal materials, particularly catalytic converters. The bill introduces a new provision that allows the sale of restricted metal materials if the seller can provide written documentation proving ownership or authorization to sell the item. Recyclable metal dealers are now required to copy and maintain this documentation along with their purchase records. The bill also changes language from "licensed recyclable metal dealer" to simply "recyclable metal dealer" and expands the permissible location for selling a detached catalytic converter, allowing sales to occur at either the seller's or the dealer's fixed business address. These changes appear designed to provide more flexibility for metal sellers while maintaining documentation requirements that can help prevent the sale of stolen metal materials. The bill specifically addresses previous restrictions on purchasing items like government and utility equipment, cemetery markers, and detached catalytic converters, creating a more nuanced approach to regulating metal sales.
