This bill permanently removes the sunset provision (expiration date) for an existing law that excludes certain narcotic testing equipment from being classified as drug paraphernalia. Specifically, the bill amends Tennessee Code Annotated Section 39-17-402 to eliminate the previous July 1, 2025 repeal date for an exception that allows possession of testing equipment used to determine whether a controlled substance contains a synthetic opioid. The equipment remains legal to possess unless it is intended to be used in commission of a drug offense. By removing the sunset date, the law will continue to provide this exemption indefinitely, which helps harm reduction efforts by allowing individuals and organizations to use testing equipment to identify dangerous synthetic opioids like fentanyl without fear of legal prosecution. The bill takes effect immediately upon becoming law, as determined by the Tennessee General Assembly.
