Bill Summary

Amends the Preventing Sexual Violence in Higher Education Act. Requires each higher education institution to biennially (rather than annually) conduct a sexual misconduct climate survey of all students at the institution. Adds the Executive Director of the Illinois Community College Board, members appointed by the Board of Higher Education, and members appointed by the Illinois Community College Board to the Task Force on Campus Sexual Misconduct Climate Surveys. Removes some members of the Task Force who were appointed by the Governor. Requires the Task Force to meet to recommend updates and revisions to the base survey (rather than to review the results of the survey and to implement updates and improvements). Removes the civil fine imposed upon an institution that violates the provisions or fails to carry out the provisions. Makes other changes.

AI Summary

This bill amends the Preventing Sexual Violence in Higher Education Act to modify requirements for sexual misconduct climate surveys at higher education institutions in Illinois. The key changes include shifting from annual to biennial (every two years) survey requirements, expanding the Task Force on Campus Sexual Misconduct Climate Surveys by adding members from the Illinois Community College Board and removing members previously appointed by the Governor, and changing the Task Force's primary role from reviewing survey results to recommending updates and revisions to the base survey. The bill requires each higher education institution to conduct a sexual misconduct climate survey of all students, which must include a base survey provided by either the Board of Higher Education or the Illinois Community College Board. Institutions may add their own campus-specific questions, but these must be trauma-informed and cannot require disclosure of personally identifying information. The survey will collect anonymous data on topics such as sexual misconduct incidents, student awareness of institutional policies, reporting practices, campus safety perceptions, and demographic information. Importantly, the bill removes previous provisions for civil penalties against institutions that fail to comply with the survey requirements, and mandates that survey results be published on institutional websites and made publicly accessible through state board websites.
