The disclosure must be clear and easily understandable, displayed prominently before any booking information or personal data collection, and presented through the same communication method as the booking service. The disclosure cannot require additional consumer action to view, such as clicking a link, and cannot be buried in legal terms and conditions. Violations of these requirements would be considered an unlawful practice under the Consumer Fraud and Deceptive Business Practices Act. The bill is set to take effect on January 1, 2026, giving booking services time to adjust their practices to comply with the new requirements.
