This bill amends the Illinois Public Labor Relations Act to provide the Illinois Labor Relations Board with additional authority to address serious unfair labor practice violations. Specifically, the bill allows the Board to determine whether a violation of the Act is so serious that traditional remedies may not adequately address the harm. If the Board finds that a violation has significantly undermined the collective bargaining process - for example, by potentially damaging support for a labor organization or weakening its bargaining strength - it can now include interest arbitration as part of its remedy. Upon request of the charging party, the involved parties would be required to participate in impasse arbitration procedures. The bill provides some flexibility in these arbitration proceedings, such as not considering the right to strike waived until the actual arbitration hearing begins and ensuring that the start of a new fiscal year does not impair the arbitration panel's jurisdiction. Throughout the process, the parties are still required to continue bargaining in good faith. This legislative change aims to provide more robust mechanisms for addressing labor disputes and protecting the integrity of collective bargaining.
