This bill adds a new section to Idaho law that creates two new crimes related to strategic facilities: impeding a strategic facility and strategic facility trespass. Under the bill, impeding a strategic facility involves knowingly and intentionally blocking the operation of or preventing legal access to a strategic facility, with penalties ranging from a misdemeanor (up to 6 months in jail and a $10,000 fine) to a felony (up to 2 years in prison and a $100,000 fine) depending on the economic damage caused. Strategic facility trespass occurs when someone enters or remains in a strategic facility without permission, with first-time offenses being a misdemeanor and repeat offenses within five years becoming a felony. The bill defines "strategic facilities" broadly, including refineries, power plants, transportation infrastructure, military facilities, and many other critical infrastructure sites. The law includes exceptions for property owners, those engaged in legal processes, and those involved in bona fide land access disputes. Importantly, the bill explicitly states that it does not apply to public demonstrations or free speech activities protected by the U.S. or Idaho constitutions. The bill also allows civil actions against individuals or organizations that aid or abet such trespassing or impeding, with potential fines up to $100,000.
