This bill adds a new section to Idaho's Residential Mortgage Practices Act to protect consumer privacy in mortgage applications by regulating "mortgage trigger leads" - consumer reports generated when someone applies for credit that can be purchased by other lenders. The bill prohibits solicitors using these trigger leads from engaging in several deceptive practices, including: failing to disclose that they are not affiliated with the original lender, not clearly stating that the solicitation is based on personal information purchased from a consumer reporting agency, not complying with federal fair credit reporting act prescreening requirements, and using the leads to contact consumers who have opted out of prescreened credit offers or who are on do-not-call lists. Any violation of these provisions would be considered a violation of the Idaho Consumer Protection Act. The bill includes an emergency clause and is set to go into effect on July 1, 2025, aiming to prevent unsolicited and potentially misleading mortgage loan marketing practices that use consumers' private application information without their direct consent.
