Under the new law, drivers who commit specific speed-related offenses can be required to have a speed inhibiting device installed on any vehicle they operate, with the duration of installation varying based on the offense: 90 days for a first speeding violation, 180 days for driving 100 miles per hour or more or for a second speeding offense within twelve months, and up to one year for accumulating excessive points or a second serious speeding violation within 24 months. The driver is responsible for paying all costs associated with installing and maintaining the device, which must electronically report compliance to the department of transportation. The speed inhibiting device must be a system that determines the roadway's speed limit and prevents the vehicle from exceeding that limit. Violations of the device requirements, such as driving a vehicle without the device or tampering with it, can result in a class one misdemeanor and further suspension of driving privileges. The bill also includes provisions for device certification, manufacturer liability, and specific reporting requirements to ensure the system's reliability and effectiveness in preventing excessive speeding.
