Specifically, the bill creates a vested property right when a preliminary or final development plan, or a building permit, is submitted to local government, provided the plan substantially complies with local development ordinances. The vesting period for a building permit is set at three years, beginning on the date of submission. Additionally, the bill provides new provisions for local governments to delegate certain decision-making powers to building commissioners or administrative officials, including requirements for rendering decisions on special exceptions within 120 days. The bill also specifies that if a local government fails to respond within the designated timeframe, the application is automatically deemed approved. These changes aim to provide more predictability and efficiency in the development approval process, giving property owners more certainty about the regulatory standards that will apply to their projects. The bill is set to take effect on July 1, 2025.
