This bill establishes the Fairness in Property Tax Foreclosure Task Force to study and make recommendations about property tax foreclosures in Illinois. The Task Force will consist of 16 members, including legislators, the Attorney General, and representatives from various organizations such as assessors, municipalities, realtors, bankers, and housing advocates. The Task Force will investigate complex issues surrounding property tax foreclosures, including constitutional due process concerns, the impact of a recent Supreme Court decision (Tyler v. Hennepin County), the rights of property owners, lenders, and government entities during tax sales, and the differences between residential and commercial property foreclosures. Members will serve without compensation but may be reimbursed for expenses, and they are exempt from certain ethics and training requirements. The Task Force is required to submit a detailed report to the General Assembly by December 30, 2025, after which it will be dissolved. The bill acknowledges the importance of homeownership as a means of building generational wealth and seeks to address complications in the current property tax foreclosure process that can result in homeowners losing their property and equity.
