This bill modifies existing law regarding the use of personal electronic devices while driving, specifically by adding a provision that doubles the base penalty for infractions committed within a school, playground, or crosswalk speed zone, as defined by RCW 46.61.440. This means that if a driver is caught using a device like a cell phone or tablet (defined as a "personal electronic device" capable of wireless communication or data retrieval, excluding hands-free devices and certain radios) in these designated safety areas, their fine will be twice the standard amount, and this increased penalty, including any associated fees, cannot be waived, reduced, or suspended. Furthermore, fifty percent of the money collected from these doubled penalties will be directed to a school zone safety account, aiming to improve safety in areas frequented by children. The bill also clarifies that "driving" includes being temporarily stopped in traffic and defines "use" of a device to encompass holding it or interacting with it for various functions, with a minor exception for activating or deactivating a function with a single finger.
