This bill amends the Nursing Mothers in the Workplace Act by renaming it the Nursing in the Workplace Act and making several key changes to protect employees who need to express breast milk. The bill requires employers to provide reasonable break time for employees to express milk for their infant child within one year of the child's birth, and these breaks can run concurrently with existing break times. Employers cannot reduce an employee's compensation for using break time to express milk, unless doing so would create an undue hardship as defined by the Illinois Human Rights Act. The bill also mandates that employers make reasonable efforts to provide a private, non-toilet location near the work area where employees can express milk. Additionally, the bill introduces a new provision that allows employees who have been denied their rights under this Act to take legal action to prevent future denials, and if successful, they will be awarded reasonable attorney's fees and costs. The bill uses gender-neutral language, replacing "her" with "the employee's" throughout the text, and becomes effective immediately.
