This bill prohibits appointed members of county boards of education from serving in leadership positions, such as president, vice president, chair, or vice chair, beginning July 1, 2025. An "appointed member" is defined as an individual appointed to the board by a government official or body, but excludes those appointed to fill a vacancy for an elected position. If an appointed member is in a leadership position on July 1, 2025, they must vacate that position by August 1, 2025. If a county board fails to remove an appointed member from a leadership role after receiving a written notification from the State Department of Education, the department may suspend administrative funding, require the board to post a violation notice on its website, and potentially withhold additional funding or refer the matter to the Attorney General for enforcement. Additionally, the department may impose a civil penalty of up to $2,500 on an appointed member who knowingly and willfully continues to serve in a leadership position after being notified of the violation. The bill aims to ensure that appointed board members do not hold top leadership roles and provides a structured process for addressing any non-compliance.
