This bill amends the Counties Code to modify competitive bidding requirements for county purchases and contracts. Specifically, the bill exempts the State's Attorney in each county from having to seek competitive bids for services related to criminal and civil litigation. The bill expands existing provisions to explicitly include elected officials in the competitive bidding rules, which previously applied only to counties. The legislation applies to counties with fewer than 2,000,000 inhabitants and requires competitive bidding for purchases over $30,000, with several exceptions. These exceptions include emergency purchases authorized by the county board, purchases of used equipment or at auction, and specific technology-related acquisitions where individual orders do not exceed $35,000. When evaluating bids, county boards or elected officials can consider factors beyond price, such as the quality of articles, conformity with specifications, suitability to county requirements, availability of support services, and the bidder's participation in apprenticeship programs. The bill also allows counties and elected officials to potentially prefer private enterprises over state-controlled enterprises when awarding contracts, and permits them to require contractors to collect and remit Illinois Use Tax on sales of tangible personal property.
