This bill amends the Mental Health and Developmental Disabilities Code to establish more detailed protocols for investigating and responding to allegations of abuse, neglect, or financial exploitation in mental health and developmental disability facilities. The bill introduces a tiered approach to employee restrictions based on the severity of alleged misconduct. For serious allegations of physical abuse, sexual abuse, significant financial exploitation (over $20), egregious neglect, or obstruction of an investigation, an employee will be immediately and permanently barred from contact with service recipients pending investigation. For less severe allegations like minor financial exploitation (under $20) or mental abuse, the facility can take alternative actions such as training, reassignment, or limited disciplinary steps. The bill defines "credible evidence" as believable and reliable information related to an incident. Importantly, the bill explicitly excludes employees of hospitals licensed under the Hospital Licensing Act or University of Illinois Hospital Act from these provisions, ensuring the regulations do not apply to hospital staff. These changes aim to create a more structured and protective framework for investigating potential misconduct in mental health and developmental disability facilities.
