Bill Summary
Reinserts the provisions of the engrossed bill with the following changes. Provides that an employee, prospective employee, or former employee and an employer may enter into a valid and enforceable settlement or termination agreement that includes promises of confidentiality related to alleged unlawful employment practices if, in addition to other specified conditions, any promises of confidentiality by the employee, prospective employee, or former employee expire within 5 years from the date that the employee, prospective employee, or former employee disclosed the alleged unlawful employment practice that is the subject of confidentiality.
AI Summary
This bill amends the Workplace Transparency Act to provide clearer protections for employees in settlement and termination agreements involving alleged unlawful employment practices. The bill allows employees and employers to enter into confidential settlement agreements under specific conditions, including that any confidentiality promises made by the employee will expire within 5 years of disclosing the alleged unlawful practice. The legislation expands definitions to include more types of employment-related issues and protects employees' rights to report workplace violations, engage in concerted activity, and testify in legal proceedings. Key provisions include requiring mutual agreement and consideration for confidentiality clauses, giving employees time to review agreements, and ensuring employees can still report criminal conduct or unlawful employment practices. The bill also prevents employers from unilaterally imposing conditions that would prevent employees from making truthful statements about workplace issues or engaging in protected activities. Additionally, the bill allows employees to recover consequential damages and attorney's fees if they successfully challenge an agreement that violates the Act's provisions, ultimately aiming to protect workers' rights and prevent workplace discrimination and harassment.
