AI Summary

This bill amends the Prevention of Tobacco Use by Persons under 21 Years of Age and Sale and Distribution of Tobacco Products Act to establish new requirements for electronic cigarette (e-cigarette) manufacturers before they can sell products in the state. Manufacturers must now register their e-cigarette products with the Department of Revenue and submit a detailed affidavit that includes information about the product's availability in the United States, its Premarket Tobacco Product Application status with the FDA (Food and Drug Administration), and a commitment to notify the department of any material changes to the product's authorization. The Department of Revenue will create a daily updated public registry of these products on its website. The bill empowers the Department of Revenue, Department of Public Health, Attorney General, and local law enforcement agencies to enforce these provisions by seizing non-compliant e-cigarette products. Manufacturers who violate these new requirements will be guilty of a Class A misdemeanor. The goal of this legislation appears to be increasing transparency and regulatory oversight of e-cigarette products to ensure they meet federal standards and are properly documented before being sold in the state.
