This bill amends Idaho Code Section 50-344 to modify provisions regarding solid waste collection systems in cities. The bill primarily adds a new provision that allows individuals to contract with any solid waste collection provider of their choice for temporary and project-specific waste containers, as defined by city ordinance, regardless of existing city contracts or franchises. The bill maintains the existing provisions that give cities the power to maintain and operate solid waste collection systems through various means, including using city employees, contracting with private companies or other government units, and covering all or part of a city's geographic area. The bill also preserves the existing language that allows mayors or city managers to exempt solid waste collection from certain procurement regulations if public safety, health, welfare, or property protection is at stake. Additionally, cities retain the ability to require performance security for waste collection contracts or waive such requirements. The bill includes an emergency clause and is set to take effect on July 1, 2025.
