Bill Summary
Amends the Environmental Protection Act. In provisions regarding ethylene oxide emissions from nonnegligible ethylene oxide emissions sources, adds requirements for an Ambient Air Monitoring Plan that substantially mirror requirements in provisions regarding ethylene oxide emissions from ethylene oxide sterilization sources. Changes the definition of "nonnegligible ethylene oxide emissions source" to any ethylene oxide emissions source permitted by the Agency that currently emits more than 30 pounds of ethylene oxide, with certain other requirements (rather than an ethylene oxide emissions source permitted by the Agency that currently emits more than 150 pounds of ethylene oxide, with certain other requirements). Removes a provision in that definition that excludes facilities that are ethylene oxide sterilization sources or hospitals that are licensed under the Hospital Licensing Act or operated under the University of Illinois Hospital Act.
AI Summary
This bill amends the Environmental Protection Act to modify regulations concerning ethylene oxide (EtO) emissions from nonnegligible EtO emissions sources. The bill lowers the threshold for what constitutes a "nonnegligible ethylene oxide emissions source" from 150 to 30 pounds of EtO emissions, and removes previous exemptions for EtO sterilization facilities and certain hospitals. The bill introduces a new requirement for these sources to submit an Ambient Air Monitoring Plan to the Agency for approval, which must include detailed plans for collecting and analyzing air samples near property boundaries and in community locations with the highest modeled impact. The sampling must be conducted quarterly using specific EPA methods (325A and 325B) over a multiple-day period, and must be performed by an independent third-party company with relevant experience. Owners or operators must provide notice of acceptance of any Agency conditions within three business days and implement the approved plan accordingly. The bill also maintains existing provisions requiring dispersion modeling using EPA methodologies, without using background ambient levels of EtO, and using comprehensive meteorological and emissions data to assess potential environmental and health impacts.
