This bill modifies the punishment for indecent exposure in the Texas Penal Code by expanding the severity of potential criminal charges based on a defendant's prior convictions. Currently, indecent exposure is typically a Class B misdemeanor, but the bill increases penalties for repeat offenders: it becomes a Class A misdemeanor for a person with one prior conviction and a state jail felony for someone with two or more prior indecent exposure convictions. Additionally, the bill introduces a new provision that elevates the charge to a state jail felony if the defendant has a previous conviction or deferred adjudication for a reportable offense, as defined in the Code of Criminal Procedure. The bill also maintains the existing provision that makes indecent exposure a third-degree felony if the actor is civilly committed as a sexually violent predator. The changes will only apply to offenses committed on or after September 1, 2025, and any offenses committed before that date will be governed by the previous legal standards.
