Provides that prior to filing for cost recovery, a qualified utility must first demonstrate good faith efforts to secure federal, State, or other relevant funding options. AI Summary

This bill creates the Utility Data Access Act, which establishes comprehensive requirements for utility data retention, sharing, and access in Illinois. The legislation mandates that utilities retain consumption data for at least 2 years, with qualified utilities required to keep monthly billing data for 15 years. Account holders can request their usage data be transmitted to any designated entity, and qualified data recipients can request aggregated usage data for buildings or properties meeting certain thresholds. The Illinois Commerce Commission will develop procedures to implement these requirements, including a stakeholder process to ensure diverse input. The bill aims to optimize energy and water use by providing building owners and tenants with easier access to utility consumption data, which can help identify efficiency opportunities, potentially reduce energy costs, and support broader economic and environmental goals. Utilities will be protected from liability for data sharing unless they are grossly negligent, and the data must be provided securely and conveniently, with specific timelines and formats depending on the utility's size. The legislation also establishes definitions for various terms like "qualified utility," "data recipient," and "aggregated usage data" to provide clear guidance for implementation.
