This bill amends Texas health and safety laws to prohibit the sale of flavored cigarettes, e-cigarettes, and tobacco products with distinguishable tastes or aromas other than tobacco. The legislation expands the definition of e-cigarettes to include consumable liquid solutions regardless of nicotine content and creates a comprehensive ban on products with flavors such as fruit, candy, dessert, chocolate, mint, menthol, alcohol, herbs, spices, and honey. The bill establishes a rebuttable presumption that a product has a prohibited flavor if the manufacturer makes public claims about its taste, uses flavor-suggestive packaging or labeling, or takes actions that would lead consumers to believe the product has a non-tobacco flavor. Violators of these new provisions will be subject to disciplinary actions similar to those for other tobacco-related violations. The new regulations will take effect on September 1, 2025, and will only apply to violations occurring on or after that date, giving businesses time to adjust to the new restrictions and potentially remove flavored products from their inventory.
