Bill Summary

AN ACT TO AMEND THE OFFENSE OF DISSEMINATING OBSCENITY TO MINORS; TO ADD THE OFFENSES OF DISSEMINATING OBSCENITY TO MINORS, DISSEMINATING HARMFUL MATERIAL TO MINORS, AND EXHIBITING HARMFUL PERFORMANCES TO MINORS TO THE LIST OF CRIMINAL CONVICTIONS THAT MAY REQUIRE REGISTRATION UNDER THE SEX OFFENDER AND PUBLIC PROTECTION REGISTRATION PROGRAM; AND TO ESTABLISH THE OFFENSES OF HABITUAL INDECENT EXPOSURE AND AGGRAVATED HABITUAL INDECENT EXPOSURE AND REQUIRE SEX OFFENDER REGISTRATION FOR THOSE OFFENSES.

AI Summary

This bill revises laws governing minors and sexual offenses by making several key changes to existing North Carolina statutes. The bill modifies laws related to disseminating obscene or harmful material to minors by expanding the scope of offenses and introducing potential sex offender registration requirements. Specifically, it updates existing statutes to remove age-specific language (like "under 16" or "under 13") and adds provisions that allow judges to require sex offender registration for individuals convicted of disseminating obscene or harmful material to minors, depending on the specific circumstances and perceived danger to the community. The bill also introduces two new offenses: "habitual indecent exposure" (a Class F felony) and "aggravated habitual indecent exposure" (a Class E felony), which apply to individuals with multiple prior convictions for indecent exposure. Additionally, the legislation amends the sex offender registration law to include these new offenses and certain existing offenses involving minors in the list of sexually violent offenses that may require registration. The bill will become effective on December 1, 2025, and will apply to offenses committed on or after that date, while not affecting prosecutions for offenses committed before the effective date.
