Bill Summary

AN ACT TO PROHIBIT LAW ENFORCEMENT AGENCIES AND OFFICERS FROM PARTICIPATING IN IMMIGRATION ENFORCEMENT IN NORTH CAROLINA PLACES OF RELIGIOUS WORSHIP, ELEMENTARY AND SECONDARY SCHOOLS, AND HOSPITALS.

AI Summary

This bill prohibits law enforcement agencies, officers, and sheriffs in North Carolina from assisting U.S. Immigration and Customs Enforcement (ICE) in immigration-related enforcement activities at sensitive locations, specifically places of religious worship, elementary and secondary schools, and hospitals. The bill prevents law enforcement from apprehending, arresting, or serving removal warrants for individuals suspected of immigration violations in these locations. Any existing or future agreements between law enforcement agencies and ICE that would violate these restrictions are automatically voided. If a law enforcement officer willfully assists ICE in these prohibited activities, they may face professional consequences, including suspension, revocation, or denial of their certification. The bill is careful to clarify that it does not prevent law enforcement from enforcing state laws as they are otherwise authorized to do. The Criminal Justice Education and Training Standards Commission and the Sheriffs' Education and Training Standards Commission are required to create rules consistent with these new restrictions, and the law becomes effective immediately upon becoming law, applying to any assistance provided from that point forward.
