This bill modifies the Texas Water Code to require the Texas Commission on Environmental Quality (TCEQ) to more carefully evaluate waste discharge permit applications by establishing two key criteria for permit approval. Specifically, before issuing a permit to discharge waste, the TCEQ must now verify that either: (1) it is not economically feasible for another existing permit holder to collect, treat, and dispose of the proposed waste, or (2) the applicant will treat and discharge the waste to a higher water quality standard than would be achieved if another permit holder handled the waste. The bill maintains the existing provision that this requirement is focused on controlling conventional pollutants typically found in domestic wastewater. The new requirements will apply only to permit applications filed on or after the bill's effective date of September 1, 2025, ensuring that existing permit applications are not retroactively impacted. By adding these provisions, the bill aims to promote more efficient and environmentally responsible waste treatment and disposal practices in Texas.
