This bill prohibits the retail sale of flavored tobacco products in New York State by establishing new regulations that define and restrict the sale of tobacco products with "characterizing flavors." Specifically, the bill defines a characterizing flavor as any distinguishable taste or aroma other than tobacco, including flavors related to fruits, chocolate, vanilla, candy, desserts, alcoholic beverages, mint, herbs, spices, and menthol. Under the proposed law, no tobacco business licensed under the state tax law can sell or offer for retail sale tobacco products with these characterizing flavors or accessories that impart such flavors. Violations of this prohibition will result in a civil fine of up to $500 for each infraction, and complaints can be submitted by any person. Importantly, the bill also includes a provision preventing law enforcement from stopping, questioning, searching, or arresting individuals based on possession, consumption, or purchase of these flavored tobacco products. The law will take effect 90 days after it becomes official, with immediate authorization for state agencies to prepare implementing regulations.
