If a potential lessee cannot provide such proof, the short-term lessor now has two options: (1) sell the person a temporary insurance policy or refer them to a third-party seller of temporary insurance at standard market rates, or (2) refuse to lease the vehicle to the person. The bill preserves existing protections against coercive sales tactics while explicitly stating that selling a temporary insurance policy does not constitute unfair or deceptive conduct. Additionally, the bill maintains existing provisions about waiver of damages charges, including price caps that are adjusted annually based on the Consumer Price Index. The legislation aims to ensure that all short-term car rental customers have adequate insurance coverage while providing flexibility for lessors to help customers meet this requirement.
