This bill establishes an Office of the State Medical Indemnity Fund Ombudsperson and a Medical Indemnity Fund Advisory Panel to support and advocate for qualified plaintiffs (individuals who have been part of medical injury claims). The ombudsperson, appointed by the commissioner and selected for their expertise in neurological injuries and advocacy, will have several key responsibilities: investigating and resolving complaints from qualified plaintiffs, helping plaintiffs understand fund regulations and procedures, informing plaintiffs about their rights and available services, analyzing fund-related laws and regulations, and maintaining strict confidentiality of plaintiff records. The ombudsperson must submit an annual report detailing their activities, complaint data, and recommendations for improving the fund. Additionally, the bill creates an advisory panel comprising the commissioner, qualified plaintiffs or their representatives, physicians, medical suppliers, and other stakeholders, which will meet biannually to discuss fund operations and provide input on regulations and guidelines. The panel will include at least nine members appointed by the governor, with recommendations from legislative leaders. The bill will take effect 90 days after becoming law, and preparations for implementation can begin immediately.
