This bill increases the maximum civil penalty for filing a false lawsuit, lien, or other encumbrance with the intent to harass or hinder someone from $5,000 to $15,000. It also requires the Secretary of State to notify a debtor within 21 days of a financing statement being filed, and any party found to have violated the prohibition against false filings will be liable to the debtor for triple the court fees incurred in the judicial proceeding. Additionally, the bill modifies the notice requirements for selling an aircraft to satisfy a lien, requiring the lienholder to post notice in five public places (and at the airport if known) instead of three when no local newspaper exists.
