This bill amends Section 210 of the Labor Code to modify how penalties for failure to pay wages are recovered. Currently, an initial violation results in a $100 penalty per employee, and subsequent or willful violations incur a $200 penalty plus 25% of the withheld wages. This bill clarifies that the $200 penalty for subsequent or willful violations can now be recovered by an employee through an independent civil action, in addition to existing methods like recovery as a statutory penalty or by the Labor Commissioner as a civil penalty. The Labor Commissioner's process for issuing and enforcing citations remains the same. The bill also specifies that an employee can choose to recover the statutory penalty or enforce a civil penalty, but not both for the same violation.
